M2: The Federal Judiciary
In Module 1 we discussed the idea of the Judiciary originally being thought of as “the least dangerous branch” and its increasing power/ significance over time. Consider how the appointment of federal judges to life terms has contributed to this development. Is the life appointment of federal judges, who then have the power to nullify both federal and state statutes passed by elected representatives, compatible with the ideals of democracy? Why or why not? How much power do you think the judiciary should have relative to the other two branches of government? Explain.
