Several countries employ what is referred to as preventative constitutional review. In these instances, a high court or some other entity has the ability to rule on the constitutionality of proposed legislation prior to the enactment of the statute. Would it be a good idea if the president, Congress, and other government entities could request the judiciary to rule on the constitutionality of a proposed action prior to its implementation? Why or why not? What would be the pros and cons of this approach. In your answer consider the power of the judiciary and its relationship to other branches of government, particularly in the context of checks and balances.
